KUALA LUMPUR: Issues surrounding Tan Sri Azam Baki’s asset declaration should be central to the investigation into the Malaysian Anti-Corruption Commission (MACC) chief commissioner.

Parliamentary Special Committee on Corruption (SCC) chairman Tan Sri Rais Yatim said any ownership of assets by civil servants, including stock ownership should be declared.

Rais who is Dewan Negara president said it was learned that Azam had purchased the shares six years ago, but a factual investigation was needed to determine if he had purchased them as a beneficiary or as personal ownership.

He pointed out that, according to a government circular issued in 2002, civil servants are not allowed to purchase shares exceeding RM100,000.

“The MACC chief bought the shares six years ago. Has it been declared then? This is still unclear.

“Therefore, the SCC recommends that an investigation is conducted over Azam to get the actual facts.

“Fortunately, Azam has agreed to cooperate with the authorities over any probe against him. We hope he will explain the matter to either the police, the Public Service Department (PSD), the Securities Commission (SC), the Public Service Commission (PSC) or the Chief Secretary to the Government,” he said during a press conference at Parliament here today, after chairing the SCC Meeting.

Rais, who is a former minister said the SCC was currently awaiting reports either from the PSC, the SC, the police, or the PSD over the probe into Azam.

“The question of asset acquisition and declaration is important in any case involving government officials.”

He added that the matter had been communicated with Prime Minister Datuk Seri Ismail Sabri Yaakob on Thursday.

The premier, he said, had agreed for a meeting with the SCC soon to hand over their report and recommendations.

According to Section 14 of the MACC Act, functions of the SCC include advising the Prime Minister on any aspect of the corruption problem in Malaysia, to examine annual report of the Commission, and to examine the comments of the Anti-Corruption Advisory Board.

On a related matter, Rais said economist Prof Dr Edmund Terence Gomez’s role as a whistle-blower should not be doubted and instead should have served as a basis for investigations into Azam.

“Complaints, however, must be made with the highest prudence and via the right channel.”
